LIABILITY WAIVER & RELEASE OF CLAIMS
Participant / Visitor Acknowledgment and Agreement
By entering or participating in any activities at Ace Active Zone (the “Facility”), I acknowledge, understand, and agree to the following terms:
1. Personal Responsibility and Insurance
I understand that Ace Active Zone does not provide medical, accident, or liability insurance for participants, guests, or spectators. I acknowledge that I am solely responsible for maintaining my own health, accident, and liability coverage, and for any medical or related expenses that may result from my participation or presence at the Facility.
2. Assumption of Risk
I recognize that participation in athletic, recreational, and social activities involves inherent risks of injury, illness, paralysis, or death, as well as potential property loss or damage. These risks include, but are not limited to, slips, trips, falls, collisions, sprains, fractures, equipment failure, impacts with other participants, and unsafe surface conditions.
I freely and voluntarily assume all such risks, whether foreseeable or not, associated with my presence or participation at Ace Active Zone, including those arising from the actions, inactions, or negligence of others.
3. Release of Liability
To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Ace Active Zone, its owners, officers, directors, employees, agents, contractors, affiliates, and representatives from any and all claims, demands, damages, or causes of action, whether known or unknown, arising out of or related to any injury, illness, death, accident, loss, or property damage that may occur on or about the premises.
This includes those caused by ordinary negligence, except where caused by gross negligence or intentional misconduct of Ace Active Zone or its representatives.
I understand that by signing this agreement or by being present at the Facility, I am giving up my right to sue or bring any legal action against Ace Active Zone for ordinary negligence. This also applies to my family and/or our estate.
4. Personal Property
I understand and agree that Ace Active Zone is not responsible for the loss, theft, or damage of personal property, including but not limited to clothing, equipment, electronics, jewelry, or vehicles, whether stored in lockers, common areas, or parking lots. I accept full responsibility for securing my belongings at all times.
5. Medical Treatment Authorization
In the event of an injury, accident, or medical emergency, I authorize Ace Active Zone to secure or provide medical assistance as deemed necessary. I agree to be solely responsible for all related medical costs or expenses incurred.
6. Rules, Conduct, and Safety
I agree to abide by all Facility rules, safety guidelines, signage, and staff instructions. I understand that failure to follow these rules or behave irresponsibly may result in my removal from the Facility without refund or recourse.
7. Photo and Video Release
I grant Ace Active Zone the irrevocable right to photograph and/or video record my participation in activities at the Facility. I authorize the use of such images or recordings for promotional, advertising, social media, and educational purposes without compensation. I waive any right to inspect or approve the finished media or materials.
8. Electronic Signature Consent
By signing or submitting this form electronically, I consent to the use of my electronic signature, which shall be deemed binding and legally enforceable as if signed in ink. I understand that I may request a paper copy of this waiver at no cost.
9. Severability
If any provision of this agreement is held to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
10. Parent / Guardian Acknowledgment (for minors)
If the participant is under 18 years of age, the undersigned parent or legal guardian affirms that they have read, understood, and agree to all terms of this waiver on behalf of the minor. The parent or guardian also agrees to indemnify and hold harmless Ace Active Zone from any claims arising from the minor’s participation.
11. Group Bookings
I understand and acknowledge that all terms also apply to those who participate or spectate in activities booked by another individual such as a Coach, Manager, Teammate, Instructor, Parent, Friend, or Family Member.
12. Acknowledgment of Understanding
I have carefully read and fully understand this Liability Waiver and Release of Claims. I acknowledge that I am voluntarily assuming all risks of injury, illness, or death, and releasing Ace Active Zone from all liability for claims arising from my participation or presence at the Facility.
I further acknowledge that I am waiving certain legal rights, including the right to sue for ordinary negligence.
My presence at the facility will be deemed just as valid as a signed acknowledgment.
